I am still In the early stages of fleshing out my idea. My website needs data to be submitted by users. I am contemplating between anon data vs using some auth mechanism (say google). After users submit their data, who owns this data? For example in terms of monetization (which I may do much further after growth) can I sell it to some other corporations?
I want to get this right from the start. So would appreciate any insights and/or things I should potentially add to my terms of service.
To add some more context, what I have in mind is letting users submitting data (incl. anon users).
I am in SF bay area. Any pointers on who I can talk to are appreciated!
Be warned - if you plan on any European people visiting or using your idea I would advise you check up on GDPR https://ico.org.uk/for-organisations/guide-to-data-protection/guide-to-the-general-data-protection-regulation-gdpr/principles/
Good luck
IANAL, but it probably depends on what type of content you're collecting. Personal information VS. user generated content probably have different laws regarding what you're able to claim and do with it, and different laws on how that process has to be handled. In either case, it needs to be explicitly called out in your TOS on who owns what.
If you're planning to monetize personal information or claim ownership over user generated content I would get in touch with a lawyer who specializes in this type of stuff. You're going to want a rock solid terms agreement to fall back on if someone gets upeset, and if you're not a lawyer I wouldn't write one on my own.
