App name already registered as a trademark in the UK

indduo

Hi all. I am about to create my first product. It's not meant to be the best idea in the world but to serve me as a leaning for future and better ideas.
It's just a simple Web service. Free to use.
I was thinking about names and came up with one that seems to be a good fit for it. The name in question is FootPoll. I registered the domain footpoll.app since .com was taken (nothing in there).
The problem is that I just checked UK trademarks registry and found that "footpoll" is already taken.
I would like to know your recommendations on what I should do. Think of another name? Release the app anyway if there is no overlapping on business features?

First of all, for what services and countries is it registred? And where are you located?
For example, if it's registred for Food supplements in the UK you shouldn't care about it. If it's registred for something similar like "web services" in the country, where you are located. Then you should maybe look for another name 😉.

Thank you for the response. We are in the same location and bot are related to digital services. I checked and it used to be a iOS/Android app but they are not available any more so they may have stopped operating. However, the owner still keeps the trademark.

Ok, then I wouldn't risk it, if I were you. It could lead to a lawsuit.

Thanks for the response! I will change the name. It also may help me to move away from that name (I guess I was too attached to it) to something more relevant to the audience/country I am aiming for.

You can always contact the owners. If they dont really use the trademark anymore they might be willing to sell it for a small anount of money.
