Only UK and Canada have specific email marketing laws. Australia has banned them overall. But most of the other countries do not regulate email marketing.

Email marketing regulations are different in each country. The good news is that there are many guidelines to follow.

    1. You must keep your email list completely separate from your other mailing lists. You have to keep that email list clean from any old addresses.
    2. You also have to offer people a way to unsubscribe if they want to stop receiving emails from you.
    3. You also must allow people to change or add information to their email list profile.
    4. You need to make clear what information people must give you in order to sign up for your mailing list.
    5. You also need to state how long you will keep your email list.
    6. You must also tell how you will separate people’s email addresses from your mailing list.
    7. You are not allowed to send or receive emails that are promoting or advertising a new product, service, or sale.
    8. You also cannot send emails to your mailing list promoting or advertising any items or services that your mailing list will not receive.
    9. You also have to designate someone on your staff to monitor your mailing list and make sure it is not used for any type of spamming activity.

Email is one of the most effective marketing channels available today.
There are number of different laws that guide the use of email marketing for commercial purposes. It’s the CAN-SPAM act in the US, the CASL laws in Canada, and, in the UK, it’s a set of laws known as the Privacy and Electronic Communications Regulations of 2003.
All of these laws dictate a number of conditions that email marketers need to follow to avoid significant fines.
While this may sound intimidating, if you’re a legitimate business using a proper email marketing tool to send legitimate email campaigns, you are likely already complying with the rules.
These laws are largely targeted at spammers and are designed to prevent them from acquiring people’s email addresses without their permission and spamming them with unsolicited emails.
However, there are a few nuances in the laws that even marketers with the best intentions can accidentally violate, so it’s important to be informed on how to be compliant.
The following is a simple list of things marketers like you can do to ensure your campaigns are compliant with all the laws across the globe.

    1. Ensure you have permission to email the people on your list
    2. Don’t use misleading header information
    3. Identify your email as an advertisement
    4. Include your address
    5. Include a way to opt-out of receiving future emails from you
    6. Honor opt-out requests promptly
Email laws are looser for transactional emails
A majority of the anti-spam laws around the world are designed to guide the sending of commercial email marketing messages, and they apply to any sort of newsletters, marketing announcements, or promotional campaigns your business might be sending. Awesome! Working on an app that will be sending newsletters on customers behalf, so this is helpful to see what's required outside our GDPR laws in the UK.
