A lot of companies, especially big ones, have very broad contract terms you sign when you're hired. They of course say that anything you do at work, or on work equipment belongs to them, but it sometimes stretches to everything you do or create during your employment in general belongs to them as well.
Who here is under one of those contracts and still works on their projects on the side? Are your worried about it?
I made it a requirement when my company hired me to remove any wording from the contract that could impede on my own stuff. And wording added to ensure that.
Rule to self - never sign with a company which has these terms.
90% of companies are probably worried about people wholesale zipping their source code and either going to a competitor or building a competitor.
The key things to thing about are:
You can assess the risk yourself using those main factors. However, there are 10% of companies out there that you need to be worried about with respect to #4. For example, if you work for a patent troll company whose goal is to scavenge as much money out of society as possible by taking advantage of the litigation culture in the US (doesn’t really exist outside the US), you might have something to worry about.
In most of the horror stories you see in the news regarding companies that enforced that clause or went after employees, the employee straight out stole the source code.
