I've been shipping new updates at Insiteful & posting here on IndieHackers for the past couple years about our form abandonment software.
Just now, an anonymous company called "Responser" (no contact or Whois) launched a new landing website that looks eerily familiar to people that have seen Insiteful.co (screenshots below: not linking, as I'd rather not give them any traffic).

It’s not the concept of form abandonment — that’s not unique to us: sites before Insiteful have done it, and others are in this space, like Gravity Forms. However, it appears that Responser directly copied our site at Insiteful, merely changing out a few words using a content spinner or AI rewriter.
The company has plagiarized entire phrases & sentences that we've used at Insiteful for 3+ years, even trademarked slogans including…
Whereas Insiteful has been around for 3+ years, this new site first popped up just a few months ago in Oct '20 (Wayback Machine screenshot below) — seems they were trying to validate the idea with just a mockup:

It looks like they have since sought to revamp their site by directly copying content from Insiteful.co (perhaps feeding it into a content spinner or rewriter) and then just pasting into the Ollie theme for Webflow.
I'm not even sure if this "copycat" actually has working software — entire pages of the website are blank, still link to old Ollie theme artifacts, or filled with spammy, poorly-written SEO text. They even claim to have a Zapier integration, yet can't be found anywhere on the official Zapier website (versus Insiteful's integration, live on Zapier.com).
That all said, to be entirely candid, I'm not too worried about these guys; Insiteful has a far superior product: with a more complete feature set at a way better price — this whole episode just validates we are on the right track.
In any case, if you're looking for tried & tested form abandonment / lead recovery software built by an expert US-based team, check out Insiteful.co! Don't bother with these other shady folks: come on over to Insiteful, we're giving out an exclusive free 14-day trial—
Just use promo code FREELEADS21 after you sign up / login and your trial will be free — no card required, no strings attached! Give it a try & just ping me here or on Twitter if you have any questions.
Thank you for taking the time to read about this — please do share any comments or suggestions! As always, myself & the Insiteful team are super appreciative of the support of the indie hacker community; thanks y'all :)
P.S. If the creator of Responser happens to read this, FYI: plagiarism and trademark infringement is not acceptable business practice, and we will be pursuing the fullest extent of action against your business.
Could you provide proof of the trademark? I can't find it on any copyright search engine.
I'm no lawyer, but I'm pretty sure you can't just trademark a basic English sentence unless it's within context or you're a giant corporation.
Edit: first impression of the page and you're just throwing trademarks on basic English sentences. Not very professional tbh.
I was about to say I didn't know it's that easy to just trademark phrases! Makes me want to just trademark a bunch of random phrases and then trick my friends into saying them so I can sue them 🤔
Such an evil plan! I love it.
Thanks for sharing the story 🙏 Whenever people try stealing my project, I treat it as flattery because it means there is enough demand for the idea :)
Regardless, always sucks when someone steals your work. Kind of reminds me of https://levels.io/flightfox-copies-nomad-list/
Thank you so much! I remember seeing that years ago, will never understand copycats
If only didn't put your promo code paragraph here....Suddenly your tone changed from an "analysis" (although quite stretched) to a blatant promotion; you lost a great deal of credibility and appeal just from those 2 paragraphs. Good job
Went through the same thing with NFT Hunt they copied the Name as well lol
What i did? Absolutely Ignored them and alerted my audience
thanks fort the story
This is good that you are talking about it publicly.
I would love to know how the whole episode pans out.
Do share the details of the legal proceedings you go with, it can be very helpful for all IndieHackers.
Since most of us here are solo founders. Accessing legal counsel can be time and money-consuming.
It would be great to have an open example of how to proceed in such circumstances.
Thanks for your post, looking forward to the next one.
Quite a few users in the comments here who are not lawyers providing very poor &/or false legal advice. As someone who owns multiple federally-registered trademarks over the last 5+ years across my various businesses, I feel I should briefly comment:
Here is my simple disclaimer: do not trust legal advice from the internet, esp. from anons on IndieHackers or any other site: most trademark lawyers offer flat-fee services which are well worth the cost -- I hired my first one while still in college.
You can trademark any phrase or sentence in any industry (ie. Nike's famous "just do it"). However, a registered trademark will only matter if the infringer operates in the same industry (NAICS code, see "Classification" in the example link). Regardless, the most important information for any trademark is the date of first use.
Legal Disclaimer: The information provided does not, and is not intended to, constitute legal advice; all information, content, and materials provided are for general informational purposes only.
If you have a registered trademark, so I think we can help you to take down all fraudulent websites. We are launching a service right now for this.

Theft or adaptation of ideas is normal in the IT world. It's extremely hard to have patents or lock up experiences behind legalese. It's free game.
But remember, it's competition, it breeds innovation. That's why the world is currently favouring companies that can move faster and more agile than the institutions.
A classic example is how the social media wars all stole different ideas and adapted them like tiktok's micro-videos like vine and instagram adding stories. You need to innovate to maintain your client base and ensure it doesn't get eaten up.
If the materials they used are trademarked and you used them before they did, I would definitely try any means necessary to stop that. Starting with reaching out to them via their support channels first.
However, keep in mind, Design and Tech can be copied or mimiced. But SERVICE is the key. If you rock the service and customer experience, I wouldn't worry too much about it. I would feel flattered in some way :)
Thank you for the kind words & support — truly means a lot!
